Terms and Conditions

By participating in exchanges within the Equalz platform/community, you agree to abide by the following terms and conditions:

1. Eligibility

1. Participation is open to individuals who have registered and hold an active membership.

2. All Equalz participants must be of legal age, 18 years or over.

2. Compliance with Laws

1. All exchanges must comply with applicable local and Australian laws.

2. All products exchanged must meet the current requirements as per the current:

   1.  Consumer Product Safety Standards and

   2. the Mandatory Safety Standards.

3. All members that are providing services/trades, must hold current licence/s aligned to those services/trades, as required by Australian law.

4. All members providing any care or services in relation to children and/or working with children must have a current Working with Children card.

5. Illegal, dangerous, sexual or unethical activities, including but not limited to the exchange of prohibited or regulated items, are strictly prohibited.

3. Agreement and Fulfilment of Exchanges

1. Participating members must discuss and come to a clear agreement on the terms of their exchange, swap, or trade before proceeding.

2. The value of any exchange is determined and agreed to by the participating members of the exchange.

3. Only two members can participate in each exchange, at any given time.

4. Members are required to capture what they are agreeing to exchange in its full entirety.

5. Once an agreement is made, participants are expected to follow through with the agreed exchange or trade.

6. If the exchange or trade cannot occur at the agreed time, all parties involved must work together to reschedule and complete the exchange at a mutually acceptable time.

7. If the exchange or trade cannot occur, the participant who is unable to fulfil their agreed trade will need to rectify this with the other participant and negotiate another suitable exchange or trade that is suitable for both parties.

4. Prohibited Activities

1. There are to be no exchanges involving illegal substances, weapons, counterfeit goods, stolen items, or any items restricted by law.

2. Any activity that violates intellectual property rights or infringes upon the rights of third parties is not allowed.

5. Accuracy and Integrity

1. Participants must provide accurate and truthful descriptions of items or services being exchanged.

2. Misrepresentation, fraud, or deceptive practices will result in disciplinary action.

6. Liability Disclaimer

1. The platform/community does not guarantee the quality, safety, legality, or value of exchanged items or services.

2. Participants assume all risks associated with exchanges and release Equalz Pty Ltd, the Equalz platform and the community from any liability.

3. Equalz members are responsible for ensuring services are being provided by the relevant qualified professionals and sight the required, relevant and current certifications/qualifications/licences from the providing participant.

4. Equalz Pty Ltd recommends that children are supervised by their parent/legal guardian.

5. Equalz Pty Ltd does not take responsibility for any lack of precaution taken in members' safety or provision of products/services obtained.

7. Failure to honour agreed Terms of exchange, trade or swap

1. Failure to honour agreed exchange terms without valid reason, will result in assessment of the failed exchange by an Equalz staff member.

2. Where a participating member has not provided a valid reason for the failed exchange or made a reasonable attempt to reschedule the exchange or complete the exchange, this will result in:

   1. The suspension or cancellation of the violating members' Equalz membership.

8. Termination of Membership

1. Violations of these terms will result in the immediate termination of membership.

2. Equalz Pty Ltd reserves the right to suspend or ban individuals based on evidence of misconduct or violation of terms and conditions.

9. Moderation and Oversight

1. All exchanges may be monitored to ensure compliance with these terms.

2. Equalz Pty Ltd reserves the right to cancel or refuse exchanges deemed inappropriate or in violation of terms.

10. Privacy and Confidentiality

1. Participants are prohibited from sharing personal or sensitive information of other members.

2. All exchanges must adhere to the privacy policy, as outlined in the Guidelines to the Information Privacy Principles.

11. Reporting Violations

1. Participants are encouraged to report any suspected violations or unethical behaviour to the Equalz administrators.

​

12. Amendments

1. These terms may be updated periodically. Continued participation in exchanges constitutes acceptance of the latest terms.

By engaging in exchanges, you confirm that you have read, understood, and agree to abide by these terms and conditions. Failure to comply may result in immediate disciplinary actions, including but not limited to the termination of membership and reporting to legal authorities, where applicable.
